1. What is copyright?

Copyright is a form of legal protection that gives creators of original works exclusive rights to copy, distribute, display, and adapt their works. Protected works include text, images, music, videos, software, and more. Copyright generally arises automatically when a work is created, without registration. However, registering a copyright may provide additional legal advantages when enforcing rights.

2. Can I use content from copyrighted works?

In general, you may not copy, distribute, or publicly display copyrighted works without permission from the copyright owner. There are exceptions, such as fair use, or situations where you have authorization, such as a license or open-license material. If you are unsure, it is best to obtain permission from the copyright owner or use copyright-free materials that are permitted for commercial use.

3. What is fair use?

Fair use is a copyright law principle that allows limited use of copyrighted works without permission in certain circumstances, such as commentary, news reporting, teaching, research, or parody. Whether a use qualifies as fair use typically depends on four factors: the purpose and character of the use, the nature of the original work, the amount used, and the effect on the market value of the original work. Fair use has strict limits and does not mean that any content may be used freely.

4. Can Arkee decide who owns a copyright?

No. Arkee is not a court or copyright arbitration body, and we cannot determine who truly owns a work. We process infringement complaints according to the DMCA notice and counter-notice procedure. If we receive a complete and compliant DMCA notice, we may remove or disable access to the reported content as required by law. If the uploader submits a valid counter-notice, we may restore the content unless the copyright owner files a lawsuit within the statutory period.

5. How does Arkee handle DMCA notices?

When we receive a complete and valid DMCA notice, we will:

• Review whether the notice includes all required legal elements, including signature, contact information, description of the work, infringing URL, and required statements;
• If the notice is complete, remove or disable access to the reported content within a reasonable time, which may take up to 14 business days;
• Attempt to contact the user who uploaded or saved the reported content and inform them that they may submit a counter-notice;
• Keep records of the complaint and cooperate with legal procedures when necessary.

6. What should I do if my copyright is infringed on Arkee?

If you are a copyright owner or authorized agent and believe your work appears in Arkee services without authorization, such as through a cloud storage shared link or file, you may:

• Submit a notice through the “Submit DMCA Notice” section of this Help Center or email us at admin@setbiuram.com;
• Make sure to provide complete legally required information, including your signature, contact information, work description, infringing URL, and required statements;
• We will process qualified notices as soon as possible.

7. What are the requirements for a copyright infringement notice?

Under the DMCA, a valid infringement notice must include:

• A physical or electronic signature of the copyright owner or authorized agent, usually by typing your full name;
• A description of the copyrighted work, such as title, original link, publication date, or other identifying information;
• The specific location of the infringing content, including the exact URL on Arkee;
• Your contact information, including a required email address and optional phone number;
• A good-faith statement: “I have a good-faith belief that the use described above is not authorized by the copyright owner, its agent, or the law”;
• An accuracy statement: “I declare that the information in this notice is accurate, and that I am the copyright owner or authorized agent, under penalty of perjury.”

If any required element is missing, we cannot process your notice.

8. I have the right to use this content. Why was it removed?

If your file was removed, it is usually because a third party submitted a DMCA notice claiming that your content infringed their copyright. Even if you believe you have permission, such as authorization or fair use, we cannot make that legal determination after receiving a complaint. You may submit a counter-notice to request restoration of the content. Please see the next question.

9. How do I submit a counter-notice?

If your content was removed because of a DMCA notice and you believe the removal was a mistake, such as because you own the copyright, have authorization, or the use is fair use, you may submit a counter-notice. A counter-notice must include:

• Your name and contact information, including email address, physical address, and phone number;
• Identification of the removed content, including the original URL;
• A statement that you consent to the jurisdiction of the federal district court for your location and will accept service of process from the copyright owner or their agent;
• A statement, under penalty of perjury, that you have a good-faith belief the content was removed due to mistake or misidentification;
• Your electronic signature.

10. What are the consequences of submitting a false DMCA notice?

Knowingly submitting a false or misleading DMCA notice is unlawful. Under Section 512(f) of the DMCA, anyone who knowingly misrepresents that material is infringing may be liable for damages caused by that misrepresentation, including attorney’s fees. Perjury may also carry criminal consequences. Please make sure you are the copyright owner or an authorized agent before submitting a notice.
